1) Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of Bajwa Oriental Style e.K. (hereinafter "Seller") apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller for goods displayed in the Seller's online shop. Any contrary terms from the Customer are not accepted unless otherwise agreed.

1.2 These GTC also apply to contracts for the delivery of vouchers, unless otherwise agreed.

1.3 A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.

1.4 An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the course of their commercial or independent professional activity.

2) Conclusion of Contract

2.1 Product descriptions in the Seller's online shop do not constitute binding offers but serve to invite the Customer to submit a binding offer.

2.2 The Customer can submit an offer via the online order form. After placing products in the cart and completing the order process, the Customer submits a binding contract offer by clicking the final order button. Alternatively, an offer may be submitted by email, fax, or telephone.

2.3 The Seller may accept the Customer’s offer within five days by:

The contract is concluded when one of the above events occurs first. The acceptance period begins the day after the offer is submitted and ends after five days. If the offer is not accepted within this period, it is deemed rejected.

2.4 If PayPal is selected, payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., under their terms: PayPal Terms.

2.5 If Amazon Payments is selected, payment is processed via Amazon Payments Europe s.c.a., under their terms: Amazon Terms.

2.6 The contract text is stored and emailed to the Customer. No further access is provided.

2.7 The Customer can identify errors before submitting the order. Browser zoom may assist. Corrections can be made using standard keyboard and mouse functions before clicking the final button.

2.8 The contract is available in the languages specified in the online shop.

2.9 Order processing and communication occur via email. The Customer must ensure a correct email address and check SPAM filters.

3) Right of Withdrawal

3.1 Consumers have a statutory right of withdrawal.

3.2 Details are provided in the Seller's cancellation policy.

4) Prices and Payment Terms

4.1 Unless stated otherwise, prices include VAT. Shipping costs are listed separately.

4.2 For deliveries outside the EU, additional costs (e.g., bank fees, customs duties) may apply and must be borne by the Customer.

4.3 Available payment methods are shown in the online shop.

4.4 If prepayment is agreed, payment is due immediately unless otherwise agreed.

4.5 For “SOFORT” payments, the Customer must authorize payment through SOFORT GmbH. Details: SOFORT.

4.6 Shopify Payments are processed via Stripe Payments Europe Ltd. Details: Shopify Payments.

4.7 When purchasing on invoice, payment is due 14 days after receipt unless agreed otherwise. The Seller may limit this payment method to certain order volumes.

4.8 When Klarna invoice payment is selected, payment is due 30 days after invoicing to Klarna AB, subject to credit approval. Klarna terms apply.

4.9 When PayPal invoice payment is selected, PayPal performs a credit check. If approved, payment is due 30 days after receipt. PayPal terms apply: PayPal PUI.

5) Delivery and Shipping Conditions

5.1 Delivery is made to the address specified by the Customer unless agreed otherwise.

5.2 If delivery fails due to Customer fault, the Customer bears resulting costs, except in the case of a valid withdrawal.

5.3 Risk transfers upon handover to the Customer or a designated person. For entrepreneurs, risk transfers upon dispatch to the carrier unless the carrier was not designated by the Seller.

5.4 The Seller may withdraw from the contract if self-supply fails through no fault of their own. The Customer will be informed and refunded promptly.

5.5 If collection is offered, the Customer can collect goods during business hours. No shipping costs apply.

5.6 Vouchers are provided via email.

6) Retention of Title

The goods remain the property of the Seller until full payment has been made.

7) Liability for Defects (Warranty)

Unless otherwise specified, statutory warranty rights apply.

7.1 For entrepreneurs:

7.2 These limitations do not apply to damage claims or cases of fraud or digital product obligations.

7.3 Statutory recourse claims remain unaffected.

7.4 Merchants must inspect and report defects per § 377 HGB.

7.5 Consumers are encouraged to report obvious transport damage but are not obligated.

8) Liability

8.1 The Seller is liable without limitation for:

8.4 The above also applies to agents and representatives.

9) Redemption of Promotional Vouchers

9.1 Promotional vouchers are valid only in the online shop and during the indicated period.

9.2 Certain products may be excluded.

9.3 Redemption is only possible before completing the order.

9.4 Only one voucher can be redeemed per order.

9.5 Minimum purchase value must match the voucher value; no refunds of unused credit.

9.6 Any difference must be paid using a valid payment method.

9.7 Vouchers are not paid out in cash or interest-bearing.

9.8 If goods purchased with a voucher are returned, the voucher is not refunded.

9.9 Vouchers are transferable; the Seller may fulfill to any presenting party unless clearly unauthorized.

10) Redemption of Gift Vouchers

10.1 Gift vouchers purchased in the online shop are redeemable there unless otherwise stated.

10.2 Valid for three years after purchase year-end. Remaining balances remain until expiration.

10.3 Must be redeemed before completing the order.

10.4 Only one gift voucher may be redeemed per order.

10.5 Cannot be used to purchase additional gift vouchers.

10.6 Any difference must be paid via another accepted method.

10.7 Not paid out in cash or interest-bearing.

10.8 Gift vouchers are transferable under similar rules as promotional vouchers.

11) Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this only applies if no mandatory consumer protection rights are overridden in their country of residence.

12) Jurisdiction

If the Customer is a merchant, legal entity under public law, or has its business address in Germany, the Seller's business location is the exclusive place of jurisdiction. If outside Germany, and the contract relates to business activity, the same applies. In all cases, the Seller may also sue at the Customer's place of business.

13) Alternative Dispute Resolution

The Seller is neither obliged nor willing to participate in dispute resolution procedures before a consumer arbitration board.
